personal data is any information concerning certain individual (subject of personal data), including such person’s last name, name, patronymic name, year, month, date and place of birth, address, marital, social, property status, education, occupation, income, and other information;operator is a state body, municipal body, legal entity or individual that arranges for and/or performs processing of personal data, and identifying goals and content of personal data processing;personal data processing is a manipulation (operations) of personal data, including collection, systematization, gathering, storing, adjustment (updating, modification), use, distribution (including transmission), depersonalization, blocking, destruction of personal data;Personal data processing can be performed by an operator against consent of subjects of personal data with the exception of cases provided below:1) personal data processing is performed on the basis of federal law, that provides for its goal, conditions for acquisition and set of subjects, whose personal data is subject to processing, and regulating power of operator; 1.1) processing of personal data is necessary due to realization of international agreements of the Russian Federation on readmission;2) personal data processing is performed for the purpose of execution of the contract, one part to which is a subject of personal data;3) personal data processing is performed for statistical or other scientific purposes provided obligatory depersonalization of personal data;4) personal data processing is required for protection of life, health and other vital interests of a subject of personal data, if acquisition of consent of such subject of personal data is impossible;5) personal data processing is required for delivery of postal items by post organization, for settlement of payments for rendering of communication services between telecommunication operators and their customers, and for consideration of claims of such customers;6) personal data processing is performed in order to carry out professional activities by a journalist for the purpose of scientific, literary or other creative work provided that there is no breach of rights and liberties of a subject of personal data;7) personal data processing is performed for data subject to publication in accordance with federal laws, including personal data of individuals in positions of officials, civil service officials, personal data of candidates to elective state and municipal posts. Article 152.1. Civil Code of the RF, Protection of images of citizensPublication and further use of image of a citizen (including such citizen’s photos, video records or pictures where such citizen is depicted) is only allowed with the consent of such citizen. After death of a citizen his/her image can only be used with consent of such citizen’s children or spouse, or parents. Such consent is not required in the following cases:1) when image is used in the state, social or other public interests;2) when image of a citizen is obtained during filming that was performed in public places or at public events (meetings, conferences, concerts, shows, sporting events or similar events), with the exception of cases when such image is a major object of use;3) when a citizen posed for certain payment. Free use of work constantly available in public placesIt is allowed without consent of author or other right holder and without payment of remuneration to reproduce, on-air or cable broadcast photos, architectural or visual art works that are constantly available in public places with the exception of cases when display of work in such manner is the main object of such reproduction, on-air or cable broadcast, or when a work image is used for commercial purposes. Each person has the right to privacy, personal and family secret, and protection of their honor and good name.Life and health, personal dignity, privacy, honor and good name, business reputation, personal and family secret, right of movement, right to choose place of stay and residence, right to a name, authorship right, other personal intangible rights and benefits, owned by a citizen from birth or according to the law, are inalienable and non-transferrable in any manner. In cases and according to procedure provided for by the law, personal intangible rights and other benefits owned by a dead person can be exercised and protected by other people including heirs of right holder.Regulations regarding protection of business reputation of person apply to the protection of business reputation of legal entity correspondingly.Discrediting information includes in particular statements about violation by a citizen or a legal entity of effective legislation, commitment of dishonest deed, faulty, unethical behavior in personal, social or political life, bad faith when performing economic or entrepreneurial activity, violation of business ethics or business practices that belittle honor and dignity of a citizen or business reputation of an individual or legal entity, in case such information does not reflect the reality.
